Terms of Service

These Terms govern your use of Jimp, a service operated by PANDACORP SARL, 7B rue du Chapeau Rouge, 21000 Dijon, France (RCS Dijon 823 671 524). By creating an account or using the service, you accept them. If you do not accept them, do not use the service.

1. What Jimp is

Jimp is a hosted software service. It lets you create, configure and operate websites that aggregate and publish adult content, and it hosts those sites for you for as long as your subscription is active.

Jimp is a tool sold to professionals. It is not a marketplace for adult content, and PANDACORP SARL does not sell adult content to consumers.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live if it is higher, and legally allowed to operate an adult website in your jurisdiction. You must be acting for purposes relating to your trade or profession. You confirm both when you create an account.

3. Your account

You are responsible for the accuracy of the information you give us, for keeping your credentials secure, and for everything done through your account. Tell us at contact@jimp.io without delay if you believe it has been compromised.

One person or company, one account. Do not resell access to your account, and do not share it outside your own organisation.

4. Subscriptions, prices and payment

Subscriptions are sold per period (monthly or yearly) at the prices shown on the pricing page at the time of purchase, and they renew automatically at the end of each period until you cancel.

  • Prices are stated exclusive of VAT unless indicated otherwise. VAT is applied where it is due, based on your status and your country. Business customers in the European Union who provide a valid VAT number are invoiced under the reverse charge mechanism.
  • An invoice is issued for each payment and made available in your account.
  • We may change prices. A change never applies to a period already paid for; we will tell you before it applies to a renewal, and you are free to cancel before then.

5. What happens if payment stops

If a subscription lapses, your sites are not deleted. The service continues in a reduced form described in the product and in the documentation: the site stays online, automated content updates stop, and monetisation reverts to Jimp's own placements until payment resumes. Nothing you built is lost, and paying again restores it.

6. Your content and your sites

You keep ownership of everything you upload, write, or configure. You grant PANDACORP SARL the licence it needs to host, reproduce, adapt for display, and serve that material for the sole purpose of running the service on your behalf.

You are the operator and the publisher of the sites you create with Jimp. That means you are responsible for:

  • the legality of what those sites publish, wherever they are accessible;
  • age verification and the notices your jurisdiction requires;
  • record-keeping obligations attaching to sexually explicit material, including 18 U.S.C. 2257 where it applies;
  • responding to copyright notices and removal requests concerning your sites;
  • the terms, privacy policy and consumer information your own visitors and customers are entitled to.

Acceptable use lists what may not be published or done with the service. It is part of these Terms.

7. Our role

PANDACORP SARL provides hosting and software. It does not review or approve what customers publish before it goes online, and it does not act as the seller of the content its customers distribute.

PANDACORP SARL acts on reports of illegal or infringing material, and removes or disables access to content when required. Reports go to contact@jimp.io.

8. Availability

We work to keep the service and the sites it hosts available, but we do not promise uninterrupted service. Maintenance, incidents, and failures at third-party providers happen. We do not offer a service level agreement unless one has been agreed separately in writing.

9. Suspension and termination

You may stop using the service at any time by cancelling your subscription.

We may suspend or terminate an account, with notice where circumstances allow and immediately where they do not, if it breaches these Terms or the Acceptable Use Policy, if it exposes us or our providers to legal risk, or if payment fails and is not resolved. Content that is manifestly illegal is removed without prior notice, and reported to the competent authorities where the law requires it.

10. Intellectual property

The Jimp software, brand, interface and documentation belong to PANDACORP SARL. Your subscription grants you the right to use the service, not to copy, resell, decompile or reproduce it.

11. Liability

The service is provided as is. To the fullest extent permitted by law, PANDACORP SARL is not liable for indirect or consequential damage, for loss of profit, revenue, traffic or data, nor for the acts of your visitors, your customers or third-party platforms whose content your sites display.

Where liability cannot be excluded, it is limited to the amounts you paid for the service over the twelve months preceding the event giving rise to the claim.

Nothing here limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

12. Indemnity

You will hold PANDACORP SARL harmless from claims, damages and reasonable costs arising from the content published on your sites, from your use of the service in breach of these Terms, or from your failure to meet an obligation described in section 6.

13. Personal data

Our handling of personal data is described in the Privacy Policy. Where we process personal data on your behalf as part of running your sites, we do so on your instructions and for that purpose only.

14. Changes

We may update these Terms. We will announce a substantive change before it takes effect, and continuing to use the service after that date means you accept the new version. If you do not, you may cancel.

15. Governing law

These Terms are governed by French law. Disputes fall under the jurisdiction of the competent courts of Dijon, France, except where a mandatory rule gives jurisdiction elsewhere.
